• You own your uploaded photos; we only use them to run TCA and never to train AI models.
• AI-generated images are approximations, not a guarantee of fit, color, or size.
• Image credits are refunded automatically when a generation fails.

Introduction

Welcome to TCA (“The Clothing App”). These Terms & Conditions (“Terms”) are a binding agreement between you and Hello Computer (a trade name of MY STATIC SELF Ltd., Ontario, Canada) governing your use of our wardrobe-organisation and styling services (“Services”).

By using the Services you accept these Terms. If you do not agree, do not use the Services.

Eligibility

1. Age requirements. 13+ in the U.S./Canada, 16+ in the EEA/UK unless local law sets a lower “digital-consent” age (never below 13). Under-age users must have a parent or guardian open and manage the account.
2. Authority. You confirm you have legal capacity to accept these Terms.

User accounts

• Creation. Provide accurate information; keep it up to date.
• Security. You are responsible for all activity under your credentials.
• Deletion. Delete your account anytime; we erase or anonymise related data unless law requires retention.

Subscription & payment

1. Plans. Free and paid plans are shown in-app at checkout.
2. Merchant of record. Payments are processed by Polar; Polar appears on your card statement and collects any applicable VAT/GST/HST.
3. Auto-renew. Plans renew each billing cycle. Cancel anytime in My Account → Subscription to stop future charges. We send reminder e-mails where the law requires.
4. Refunds. We honour any statutory “cool-off” rights (e.g., 14 days in the EU). Outside those windows, refunds are at our discretion.
5. In-app purchases. Subscriptions and image credits bought in the iOS app are processed by Apple and managed in your Apple Account settings. Refunds for those purchases are handled by Apple under its policies.

User content

1. Ownership. You own the photos and text you upload.
2. Licence. You give us a worldwide, royalty-free licence to store, process, and display your content solely to operate TCA. We do not use your photos or generated images to train AI models.
3. Prohibited content. No illegal, hateful, exploitative, or infringing material.

AI image features

1. The features. The Fitting Room generates images for you: a model photo of you from photos you provide, try-on images, and studio flat lays of your clothing. Images are generated by a third-party AI provider (Google Gemini); see our Privacy Policy for how your photos are processed.
2. Accuracy. Generated images are AI outputs. They are approximations, may contain artifacts, and may not accurately show how a garment fits, its true color, or its size. They are not a substitute for trying on real clothing.
3. Ownership and use. You keep your rights in your photos and in the images generated for you, for personal, non-commercial use.
4. Your photos. Only upload photos of yourself, or of someone who has given you permission, and only images you have the right to use. Do not upload photos of minors.
5. Prohibited use. Do not create content that is unlawful, deceptive, harassing, or sexually explicit, or that impersonates or misrepresents another person. Clothing images you import from other sites are for your personal, non-commercial use only.

Image credits

1. Cost. Each generated image uses image credits. The cost depends on the type of image and is shown in the app before you generate.
2. Failed generations. If a generation fails or returns no image, its credits are refunded automatically.
3. Credit packs. Credits you buy as a pack do not expire. If a pack purchase is refunded, any unused credits from that pack are removed.
4. Subscription credits. Paid plans may include a monthly credit allowance. These credits reset each period, and unused subscription credits do not carry over. They are used before pack credits.
5. Credits have no cash value, are non-transferable, and cannot be exchanged for money.

Acceptable use

Don't break the law, don't abuse other users, don't interfere with the service, and don't scrape or reverse-engineer us.

Termination

You may close your account at any time. We may suspend or terminate it if you violate these Terms or the law.

Disclaimers

The Services are provided “as-is” without warranties except where such disclaimers are disallowed by law.

Limitation of liability

To the extent permitted by law, our total liability is capped at the fees you paid us in the preceding 12 months.

Governing law & disputes

Ontario law governs these Terms. You and we submit to the courts of Ontario unless your local consumer law requires otherwise.
